These General Terms and Conditions of Sale ("GTCS") govern all sales made on the OrthoDial Pro website, operated by MASCARA 29 HOLDING LLC ("we", "OrthoDial Pro"), and hosted on the Shopify platform. By placing an order on our site, you agree to these GTCS without reservation.

Article 1 – Access and customer account

Access to the site and placing orders are reserved for persons legally capable of entering into contracts. You are responsible for the accuracy of the information provided when creating your account or placing your order, as well as for the confidentiality of your credentials.

Article 2 – Our products

We take the greatest care in presenting our products. However, slight variations in color or appearance may occur depending on the screen used. We reserve the right to modify, withdraw, or limit the quantity of any product presented on the site at any time.

Article 3 – Orders

Any order placed on the site constitutes an offer to purchase subject to our acceptance. The order is only definitively validated after receipt of full payment. We reserve the right to refuse or cancel any abnormal, fraudulent, or bad-faith order. Products sold on the site are reserved for personal use and are not intended for resale.

Article 4 – Prices and payment

Prices are indicated in euros, all taxes included, excluding any delivery charges specified before order validation. We reserve the right to change our prices at any time, it being understood that the price applicable is the one in effect at the time of the order. Payment is made online, by bank card or any other method offered on the site, via a secure payment solution.

Article 5 – Delivery

Delivery times indicated on the site are estimates and do not constitute a firm commitment. The transfer of risk takes place at the moment the package is handed over to the carrier. We cannot be held responsible for delays attributable to the carrier, customs, or a case of force majeure. For more details, consult our Delivery and Return Policy.

Article 6 – Right of withdrawal, returns, and refunds

In accordance with applicable regulations, you have a 14-day withdrawal period for residents of the European Union, as well as a 30-day return period as part of our commercial policy. Detailed conditions are specified in our Delivery and Return Policy and our Refund Policy.

Article 7 – Intellectual property

All elements of the site (trademarks, text, images, videos, logos, graphic charter) are the exclusive property of MASCARA 29 HOLDING LLC and are protected by intellectual property law. Any reproduction or use without prior written authorization is strictly prohibited.

Article 8 – Third-party tools and links

The site may provide access to third-party tools or content, provided "as is," without any guarantee on our part. The site may also contain links to third-party sites over which we have no control; we disclaim all responsibility in this regard.

Article 9 – Relationship with Shopify

Our site uses the Shopify platform for hosting and order management. Every transaction is concluded directly between you and MASCARA 29 HOLDING LLC; Shopify is not a party to the sales contract and assumes no liability in this regard.

Article 10 – Personal data

The processing of your personal data is described in our Privacy Policy, which is an integral part of these GTCS.

Article 11 – Customer reviews and feedback

If you submit a review, comment, or suggestion, you grant us the free and non-exclusive right to use it for communication purposes, unless you specify otherwise. We reserve the right to moderate or not publish certain content.

Article 12 – Errors and inaccuracies

Despite our vigilance, the site may contain typographical errors or inaccuracies. We reserve the right to correct them at any time and to cancel or modify an order based on erroneous information, without our liability being incurred.

Article 13 – Prohibited uses

It is prohibited to use the site for illegal purposes, to infringe upon the rights of third parties, to transmit false information or malicious content, or to attempt to access the site by unauthorized automated means. We reserve the right to suspend or terminate access for any user who does not respect these rules.

Article 14 – Termination

We reserve the right to suspend or terminate your access to the site at any time, particularly in the event of non-compliance with these GTCS. Amounts due at the date of termination remain payable.

Article 15 – Warranties and liability

The site and its contents are provided "as is," without warranty of any kind regarding their uninterrupted availability or error-free status. To the extent permitted by law, our liability cannot be engaged for indirect damages resulting from the use of the site.

Article 16 – Indemnification

You agree to indemnify and hold us harmless against any third-party claim resulting from your breach of these GTCS or a violation of the law.

Article 17 – Severability

If a clause of these GTCS is deemed invalid or unenforceable, the other clauses retain their full force and effect.

Article 18 – Entire agreement

These GTCS, along with our policies published on the site, constitute the entire agreement between you and MASCARA 29 HOLDING LLC regarding the use of the site.

Article 19 – Applicable law and jurisdiction

These GTCS are governed by the law applicable in the State of Wyoming (United States), the registered office of MASCARA 29 HOLDING LLC, without prejudice to the mandatory consumer protection provisions applicable in your country of residence, particularly for European Union consumers.

Article 20 – Modification of the GTCS

We reserve the right to modify these GTCS at any time. The applicable version is the one published on the site on the date of your order.
